1. Acceptance of these terms
These Terms of Service ("Terms") form a binding agreement between you and Haarks International Pvt Ltd ("Haarks", "we", "us") governing your use of the Haarks Clinic app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Medical Disclaimer. If you do not agree, do not use the Service.
2. Eligibility — professionals only
The Service is available exclusively to registered medical professionals aged 18 or older. By using the Service you represent that you are a qualified, registered medical professional and that your use complies with the professional, ethical, and legal obligations applicable to you.
3. The Service
Haarks Clinic is a personal knowledge-management platform that lets you log cases, capture notes by voice or text, connect selected files from your own cloud drives, and retrieve your knowledge through a private AI Brain. The Service operates on a zero-storage model for patient files as described in our Privacy Policy.
4. Accounts & security
- You are responsible for the accuracy of your registration details and for all activity under your account.
- Keep your login credentials and device secure. Notify us promptly of any unauthorised use.
- One account is for one individual professional. Do not share your account.
5. Your content & responsibilities
You retain all rights to the content you create or upload ("Your Content"). You grant us a limited licence to process Your Content solely to operate and provide the Service to you.
You are solely responsible for ensuring you have the legal right and any necessary patient consent to process information you put into the Service, and for complying with all applicable medical-records, confidentiality, and data-protection laws. Do not input information you are not permitted to process.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of professional or regulatory obligations.
- Attempt to access another user's Brain, account, or data.
- Reverse engineer, scrape, overload, or interfere with the Service or its security.
- Misrepresent your professional status or identity.
- Rely on the Service as a substitute for independent clinical judgement (see Section 11).
7. Plans, billing & renewals
The Service is offered on the following plans. Prices are in Indian Rupees (₹) and may be subject to applicable taxes.

Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. By subscribing you authorise recurring charges to your chosen payment method until you cancel. Where you purchase through a mobile app store, billing, renewals, and cancellations are also subject to that store's policies.
8. Refunds & cancellation
- 7-day full refund on your first payment only. Subsequent renewals are non-refundable.
- The Founding Surgeon plan is non-refundable.
- A 7-day grace period applies after expiry before access is suspended.
- You may cancel at any time; cancellation takes effect at the end of the current billing period.
- After cancellation, your data is retained for up to 90 days and then permanently deleted (see Account & Data Deletion).
- Where you purchased via an app store, refunds may need to be requested through that store under its rules.
9. Intellectual property
The Service, including its software, design, logos, and content (excluding Your Content), is owned by Haarks International Pvt Ltd and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your professional use, subject to these Terms.
10. Third-party services
The Service integrates with third-party providers (such as cloud drives, AI model providers, and payment processors). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.
11. No medical advice
Haarks Clinic is an information and knowledge-management tool only. It does not provide medical advice, diagnosis, or treatment, and is not a clinical decision-support system or regulated medical device. All clinical decisions are the sole responsibility of the treating professional. See our full Medical Disclaimer.
12. Disclaimers of warranty
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. AI-generated output may be incomplete, inaccurate, or out of date and must be independently verified. We do not warrant that the Service will be uninterrupted, secure, or error-free.
13. Limitation of liability
To the maximum extent permitted by law, Haarks International Pvt Ltd and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. To the extent liability cannot be excluded, our total aggregate liability is limited to the amount you paid us for the Service in the 12 months preceding the claim.
14. Indemnity
You agree to indemnify and hold harmless Haarks International Pvt Ltd from any claims, damages, liabilities, and expenses arising out of your content, your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
15. Suspension & termination
We may suspend or terminate your access if you breach these Terms, misuse the Service, or where required by law. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including IP, disclaimers, liability, and indemnity) will survive.
16. Governing law & disputes
These Terms are governed by the laws of India. Subject to applicable law, the courts at the registered office location of Haarks International Pvt Ltd will have jurisdiction over disputes, without prejudice to any mandatory consumer-protection rights you may have.
17. Changes to these terms
We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, provide notice in the App or by email. Continued use after changes take effect constitutes acceptance.
